IMS senior jury consultants share their analysis of jury behavior gleaned from extensive experience and insights gathered over decades of designing mock trials and consulting on jury trials. This presentation takes a close look at the importance of creating a trial theme that is not only catchy and memorable but captures the essence of your case story.

You will learn how a trial theme is crafted, how it curates your evidence and witness testimony, and why it stays with the jurors all the way through deliberations. The session also covers how to elicit confirmation bias as part of your voir dire planning so that you seat a jury that benefits your client. In addition, we discuss methods to leverage jurors' use of hindsight to strategically place counterfactuals to solidify your case story.
