Jury Consulting

  • The members of the Tsongas (acquired by IMS in 2023) team provide an insightful sounding board for trial themes, strategy, and translating complex or mundane facts into easy-to-understand concepts. Early in a case’s preparation, I found that their case strategy exercise provides a fantastic way to organize case themes and deficiencies – on both sides of the case. I also found that Tsongas consultants have real-world experience in IP cases that assists litigators beyond the traditional feedback that a general trial consultant might provide. In a recent trial, Tsongas helped our team prepare for voir dire and streamline our case presentation, and received useful feedback throughout the trial. It is difficult to argue with the results in both cases, which were resolved overwhelmingly in our clients’ favor.

  • Tsongas jury consultants (acquired by IMS in 2023) played an invaluable role in helping us develop our opening statement and closing argument in a recent trial. Their focus on not only themes and language, but on how the structure and flow of closing argument can influence the process of deliberations were helpful in getting jurors focused on the strengths of our case. Through Tsongas, we’ve learned that it’s not enough to just persuade jurors in opening and closing; it’s important to give them a process and the tools to take control of deliberations in a way that best serves your client’s needs. More importantly, Tsongas provided practical, real-world advice rather than just generic recommendations or abstract theory. I would recommend Tsongas to any attorneys preparing for trial.

  • I’ve been trying cases for more than 35 years and had never used a shadow jury. In the past, I had concerns about both the courtroom logistics and cost of a shadow jury. Now that I’ve completed a trial with the Tsongas (acquired by IMS in 2023) team using a shadow jury, I am a believer. The Tsongas approach is seamless, makes no additional demands on a busy trial team, and provides invaluable insights in an efficient format at the end of each trial day. You actually get an answer to the question, “How are we doing?” from the perspective of a layperson and a good feel for what the jury may be thinking. Ultimately, the feedback we obtain during our trial, and the thoughtful guidance Tsongas provided for our use of that information, played an important role in how we tried our case and allowed us to secure a favorable result.

  • Guest lectures by Tsongas Litigation Consulting (acquired by IMS in 2023) have provided enormous benefit to my Pre-Trial and Trial Advocacy students at the University of Washington School of Law. While analysis of legal issues is critical in practice, so is the development of litigation and communication strategies. Tsongas Consulting specializes in these, developing fine-tuned case stories, with a keen eye focused on language, rhetoric and visual imagery, as well as jury impact. The dynamic, interactive Tsongas teaching style fits right in with the 21st Century digital era, building skills essential to success in working with clients, judges, juries and other counsel.
